Please bring help if purchasing heavy items.  The buyer is responsible for moving and loading all items.

By registering to bid, the bidder acknowledges and agrees to all the TERMS AND CONDITIONS OF THE AUCTION.  The Terms and Conditions section includes information for registration, bidding, payment, previews/inspections, close of the auction, buyer's premium, credit card fees, pick up days and times.

Any bidder may choose to utilize the maximum bid feature on any lot.  In doing so, that bidder's MAX bid will take priority over the "Same" or "Equal" bid amount placed by another bidder after the MAX bid has been placed.  If a bidder loses an item due to another bidder placing a MAX bid on a lot, it is the responsibility of the bidder NOT the auction company or the bidder platform being used to conduct the online auction.  Any bidder can choose to use the MAX bid feature. 

SERVIER & SOFTWARE TECHNICAL ISSUES:  Neither the auctioneer, auction company nor the online bidding software and/or service provider shall be held responsible for a missed bid or the failure of the software to function properly for any reason.  The Auctioneer reserves the right to cancel, suspend, extend, or reschedule an individual item or auction event.  The auctioneer reserves the right to make changes to the auction closing times or inspection/preview dates or pick up dates.  Email notifications will be sent to registered bidders with updated information deemed necessary by the Auctioneer or the Auction company.  Please bring sufficient labor and tools needed to remove items. 

AUCTION TERMS and CONDITIONS: 

NOTE:  Every bidder must register for this auction.  We are now using a new (different) platform from any previous Estate Personal Property Auctions.

PAYMENT:  The auction company DOES NOT automatically charge any buyer's credit cards.  All items will be paid for at pick up at the auction site unless other arrangements have been made.  If you are having someone else pick up your items then you must call to get approval.  In this case, you may pay for your items with a credit card over the phone.  All items will be picked up in person at the Estate site during planned & published pick up days & times.  If other arrangements are made for pick up, items must be picked up within 10 days from the first pick up day scheduled (call to make other arrangements outside of scheduled pickup days).  If items are not picked up within 10 days or high bidder fails to respond, items will be forfeited and auctioneer will have the right to resell item. Payment types accepted:  cash, check, or credit cards.  A fee will be charged of $25 for any returned checks. If paying for an item(s) with a check that involves a title, then the title will be held until funds are verified.

CLOSING OF AUCTION:  The auction is set to close 3 items per minute; an item may extend for 1 minute each time a bidder places a bid within the last 30 seconds of closing.  Be aware, a lot of bidding happens within the last day and within the last hour. Close of bidding will be quick. If a bidder uses the Max-Bid function, their bid will take priority over other bids placed for the same bid amount.  (Note: Max-Bid function means the max bids will bid against each other, and the highest max bid will persist in the auction.)

BIDDING:  All items are sold "as is" where is.  You must be at least 18 years of age to register and place a bid on any item.  Please inspect all items prior to bidding or ask questions.  Once paid it is the buyer’s responsibility for packing, moving, and loading all items.  This includes moving, loading, and transporting any and all vehicles, autos, trailers, and all other items.  Hudgins Auctions makes no representations or warranties, expressed or implied, concerning any and all items being sold.  Descriptions of the items are believed to be correct but are not guaranteed.  If a video is posted of an item running and/or operating, it does not guarantee it will be at the time of pick up. 

Please come inspect and preview all items on scheduled preview days.  It is the buyer's responsibility to inspect all aspects of an item(s) before placing a bid.  Pictures and descriptions may be updated while the auction is online before bid ending; it is our effort to provide a better understanding of the item(s) being sold.  All due diligence periods end the date the auction is scheduled to close and prior to the end of the auction.  All bidders are responsible for their own bids!  No exceptions.  If you are unsure about any item, DO NOT BID!  Auction company reserves the right to add, delete or change any lot or item before the end of the auction.  If this happens, the high bidder on that particular lot will be notified.  Please review all photos and descriptions for each lot.  Colors may vary due to lighting or personal devices used to view such items.  

Occasionally a wrong photo may be mistakenly displayed, or additional items may be in the background of photos that do not sell with that particular lot. Please read all titles and descriptions for any and all lots that you are interested in buying.

PREVIEWS/INSPECTIONS: No sale shall be invalidated by the buyer due to the bidder/buyer not conducting their own inspection prior to placing a bid or conducting their own due diligence.  It is automatically acknowledged by placing a bid that you have personally inspected the property, hired an agent to inspect the property. or waived your right to inspect the property.  Please come inspect and preview all items on scheduled preview days.  It is the buyer's responsibility to inspect all aspects of an item(s) before placing a bid.  View details to see preview and pick up days.

Winning Bidder Notification:  You will be notified with an invoice within 3-5 hours of the closing of the auction via email.  If you do not receive that email in your inbox, please check your junk or spam folders.  Please be patient.

Some vehicles have titles, some may not have titles.  The title information will be in the description for that particular lot.  Please read the detailed descriptions for each lot.

Charge-backs:  Bidder agrees that under no circumstances will he or she initiate a charge-back.  By placing a bid, the bidder acknowledges that NO refunds will be given and no charge-backs will be made on their behalf.  Each bidder is responsible for all bids made and is responsible for payment on all items they are the high bidder on.
