Everyone wants CREEK property!  Well it is rare to find property on Hassell Creek.  And this parcel has two HUGE waterfalls & two smaller ones!  The family has referred to the main waterfall as the (40' waterfall) for generations. I did not actually measure it's total height, but I stood there taking photos recently and it is quite an awesome sight! If you are just curious, viewing the waterfall is EASY! When you drive as far as you can drive on Capps Ridge Road (currently washed out for a few feet), walk straight ahead and you cannot miss the sound and beauty of the scenic waterfalls (2).  (By the way, you will have just viewed the smaller set of waterfalls.)  That's right...there is a LARGER waterfall just a few hundred feet away from this pair of waterfalls!

To view the larger waterfalls, continue walking the Capps Ridge Road to an open gate (about 200' beyond the first waterfall to the left).  This open gate is shown as a cemetery on the survey.  There are no longer graves in this cemetery.  Walk into this area and listen for the waterfall.  The falls are straight ahead about 200'.  Trust me - it is well worth the short hike to see this sight!

At one point in history, there existed a Saw Mill, a Grist Mill and a Leather Shop located just below these falls near Hassell Creek.  This was a very active business center 100 years ago.  As you walk around the creeks, branches, and springs, you might notice some old barrel hoops and rings and remnants of other "business activities"... definitely ideal settings for those famous moonshine stills.

There is a fairly level area just east of the larger waterfall, below the cemetery location.  Just imagine your private getaway cabin within site and sound of that amazing waterfall.

CLOSING DATE is set for 60 days after a signed contract has been established.  Guaranteed Title - Please note it is our understanding the current Lonnie Smith, Sr. Family & Heirs have clear title to sell this property.  It is our role as auction firm to establish a buyer and fair market value on the property.  It is the role of the closing attorney to establish a clear title for the new owner.  If there are questions and/or concerns regarding title to this property, those will be addressed by the closing attorney prior to the completion of the transaction.
Per the terms of the purchase agreement, the Buyer will not forfeit their earnest money if clear title cannot be provided on this property.  If you have any questions, do not hesitate contacting the auctioneer.
PROCEDURE: The property will be sold as a whole.
DOWN PAYMENT: A 10% down payment of the total contract purchase price will be due immediately after being declared the buyer. The down payment may be paid in the form of personal check, business check, or cashier's check. The balance of the contract purchase price is due in cash at closing within 60 days.

ACCEPTANCE OF BID PRICES: The successful bidder will sign a purchase agreement immediately following the close of online bidding.
BUYER'S PREMIUM: A Ten percent (10%) Buyer's Premium will be added to the final bid price to arrive at the total contract purchase price paid by the Buyer.
CLOSING: Closing shall take place 60 days after the contract has been fully executed, or as soon thereafter as applicable closing documents are completed.
POSSESSION: Possession will be given at closing - Date of Deed.
TITLE: Seller shall execute a proper deed (General Warranty Deed) conveying the real estate to the buyer(s). Property will be conveyed with good, clear title. Buyer has the option to purchase TITLE INSURANCE.
REAL ESTATE TAXES AND ASSESSMENTS: The current year taxes on said Property shall be prorated to the date of closing. There are no liens on this property and all taxes are paid current.
EASEMENTS: Sale of said property is subject to any and all easements of record.

UTILITIES: Electricity serves the last house on Capps Ridge Road.  There is NO public water at the end of the road.
